Terms of Service — FiveBot

These Terms of Service ("Terms") govern access to and use of FiveBot — a hosted Discord bot, web dashboard, and related services (the "Service") — provided by SDN Ventures LLC, 30 N Gould St, STE R, Sheridan, WY 82801, USA, EIN 38-4385081 ("we", "us"). By creating an account, adding the bot to a Discord server, or purchasing a plan, you agree to these Terms.

1. The Service

FiveBot provides community-support tooling for Discord communities: a ticketing system with permanent transcripts, AI-assisted answers drawn from a knowledge base you provide, multilingual translation, moderation tooling, an opt-in cross-community ban network, optional game-server integrations, and — where enabled — AI characters ("AI NPC") and voice-conversation recording in designated administrative channels ("Bodycam"). Feature availability depends on your plan.

FiveBot is not affiliated with, endorsed by, or sponsored by Discord Inc., Cfx.re, Rockstar Games, Take-Two Interactive, or Mojang/Microsoft. All trademarks belong to their owners. Your use of Discord and of any game platform remains governed by their own terms.

2. Accounts and eligibility

Sign-in is via Discord. You must be at least 18 years old to purchase a plan and must have authority to bind the community (organization) you register. You are responsible for actions taken through your account and your team members' access, which you manage through the dashboard's roles.

3. Plans, billing, and the trial — read this section carefully

  • Prepaid periods. Paid plans are sold as prepaid periods (1, 3, 6 or 12 months). A prepaid period does not renew automatically. When it ends, your plan lapses to the lowest tier; nothing further is charged.
  • The one exception — the trial. The 7-day trial requires a payment card and, at the end of the trial window, converts into an automatically renewing subscription that charges at each renewal until you cancel it. You can cancel at any time from the dashboard, effective at the end of the current period. We send a reminder before the first charge. After you cancel, you may continue on ordinary prepaid periods.
  • Credits. AI answers, AI NPC exchanges, and recorded conversations are metered per plan. When a metered limit is reached, the feature stops — there are never overage charges. Included monthly allowances reset each month and unused amounts expire; separately purchased credit packs do not expire.
  • Refunds. First-time purchases carry a 14-day money-back guarantee — contact us within 14 days of your first payment for a full refund. Statutory rights remain unaffected.
  • Price changes never affect an already-paid period. Changes to plan prices or limits are announced at least 30 days before they apply to you.
  • Payments are processed by Stripe; we do not store card numbers.

4. Your content and your responsibilities

  • Your data stays yours. Knowledge-base content, transcripts, configuration, and NPC personas you author are your content. You grant us the license needed to operate the Service on them (hosting, processing, displaying to your community) and nothing more.
  • You are the data controller for the community data processed on your behalf (tickets, messages within tickets, applications, moderation records, recorded conversations). Our processing of that data is governed by the Data Processing Agreement, which is part of these Terms for business customers.
  • Voice recording (Bodycam) obligations. Where you enable Bodycam, YOU are responsible for: designating administrative channels, informing your community, and ensuring recording is lawful in the jurisdictions of your participants. The Service enforces its own consent flow (audible/visible announcement + explicit consent from recorded participants; no consent → no recording), but that flow supplements — it does not replace — your own obligations as controller.
  • AI NPC personas. You author NPC personas and lore, and you are responsible for their content, including its age-appropriateness for your community. We may disable personas that violate §5.
  • Knowledge-base accuracy. AI answers are generated only from your knowledge base and always cite their source, but they can still be wrong or incomplete. New organizations start in draft-only mode; enabling automatic answers is your decision and your responsibility.

5. Acceptable use

You must not use the Service to: break the law; harass or defame; process data you have no right to process; record voice conversations outside the consent flow; imitate the voice of any real person or third-party fictional character (including game characters); attempt to extract other customers' data; resell the Service; or circumvent metering, rate limits, or security controls. We may suspend accounts for material violations, with notice where practicable.

6. AI disclaimer

AI output (answers, translations, summaries, conduct reviews, NPC dialogue) is generated automatically and provided "as is". Conduct reviews are proposals for human judgment — the Service never takes automated action against a person based on an AI assessment. NPC dialogue is fiction. You must not present AI output as professional (legal, medical, financial) advice.

7. Data portability and service continuity

  • One-click export of everything — transcripts, knowledge base, configuration — is available on every plan, including the cheapest.
  • On termination, you can export your data for 30 days, after which it is deleted per the DPA.
  • Service continuity commitment: if we ever discontinue the Service, we will give at least 6 months' notice, during which export remains available. We additionally commit to releasing the Service's source code under an open-source license within 30 days of discontinuation, so a community that depends on it is never left with no path forward — this commitment does not apply to third-party integrations, credentials, or infrastructure we do not own the rights to.

8. Uptime, support, and changes

We operate the Service with commercially reasonable care; a public status page and changelog are maintained. The Service evolves — features may be added or changed; a change that materially reduces what your current paid period includes entitles you to a pro-rated refund of that period on request.

9. Liability

To the extent permitted by law: the Service is provided without warranties; our aggregate liability is capped at the amounts you paid in the 12 months before the claim; we are not liable for indirect or consequential damages, or for the acts of the platforms the Service depends on (Discord, game platforms, payment providers). Nothing limits liability for intent, gross negligence, or where the law does not permit limitation.

10. Governing law and disputes

These Terms are governed by the law of the State of Wyoming, USA, without regard to its conflict-of-law rules — the state in which we are incorporated. Disputes go to the state or federal courts sitting in Wyoming.

This does not take anything away from consumers. If you contract with us as a consumer, you keep the mandatory protections of the law of your country of residence, and you may bring proceedings in your local courts where that law gives you the right to. 11. Changes to these Terms

We may update these Terms with at least 14 days' notice (dashboard + email or Discord DM). Continued use after the effective date is acceptance. The version you accepted is recorded with its version string and timestamp.
